Description
The Town of Whitby, Durham’s Business Centre, a rapidly expanding and progressive community with a population of over 130,000 and located approximately 50 km east of Toronto, is currently seeking a highly motivated and energetic individual for this challenging opportunity.

Reporting to the Chief Administrative Officer, the Town Solicitor acts as the Town’s principal legal counsel in all matters of law affecting the municipality and is responsible for the delivery of a wide range of legal services for the Corporation.  The incumbent fulfils the role of advisor in various matters, providing legal advice to Council, the CAO, Senior Management Team and individual members of staff.  Specific duties may include, but are not necessarily limited to:

  • reviewing and commenting on the legal implications of all matters affecting the Town;
  • providing opinions to Council and Town officials respecting statutes, by-laws, documents and situations, while working collaboratively with staff to resolve legal issues facing the Town;
  • reviewing Corporate and Council actions to ensure they are within the Corporation’s jurisdiction and not contrary to law;
  • maintaining a current knowledge of municipal law, advising the Corporation on changes in legislation that affect municipal operations and assisting in the development of Corporate policies and practices to respond to such changes;
  • representing the Corporation before the Ontario Municipal Board, courts and other legal tribunals;
  • representing the Corporation in alternative dispute resolution sessions;
  • providing legal advice and guidance to Town law enforcement officials and others acting on the Town’s behalf;
  • negotiating and managing the processing of real estate and leasing transactions;
  • presenting comments and recommendations to the Chief Administrative Officer or Council respecting proposed legislation and identifying the need for any legislation to further the interests of the Corporation;
  • preparing and reviews legal agreements entered into by the Corporation;
  • providing legal support to Town departments respecting the preparation and review of by-laws, agreements and other legal documents;
  • attends Council meetings;
  • preparing an annual budget plan for Legal Services;
  • developing goals and objectives to meet the needs of the Corporation; and,
  • establishing priorities and assisting in the development of Corporate policies, plans and procedures required to support these initiatives.
Requirements

As the successful applicant, you will:

  • possess a Bachelor of Law Degree (L.L.B.) from a recognized university;
  • have been admitted to the Bar in the Province of Ontario;
  • be a member in good standing in the Law Society of Upper Canada (LSUC);
  • have ten years’ experience as a solicitor, preferably in a municipal or government environment, with a primary focus on municipal law, land development and real estate related matters;
  • possess extensive and comprehensive knowledge of municipal, real estate and land development law and all provincial authorities related thereto;
  • be conversant with relevant statutes, regulations and by-laws and adept at providing research and analysis on the legal implications of matters of law, legislation, procedures and operational and strategic decisions;
  • have the ability to communicate effectively orally and in writing with Council, the Senior Management Team, staff and the public to obtain understanding, agreement and/or approvals related to policies and programs;
  • have superior presentation, oral and written communications, negotiation, research, conflict management and interpersonal skills;
  • have proven ability to plan and prioritize a varied workload and meet objectives under own initiative, draft legal documents including contracts and by-laws, to think on one’s feet, advocate and do research, provide advice and problem solve;
  • be able to prepare and present matters to courts and tribunals, especially planning matters before the Ontario Municipal Board;
  • have demonstrate proficiency in the use of personal computers and Windows based computer applications; and,
  • possess and maintain a valid unrestricted Ontario Driver’s Licence (minimum Class “G”) in good standing and have access to a personal vehicle.
Salary & Benefits

Salary: Subject to skills, abilities and qualifications

Hours: Monday to Friday, 8:30 a.m. to 4:30 p.m. – flexibility is required noting that this position requires hours outside of normal business hours
