As municipalities get ready for winter operations, training of staff is a must-do component of those preparations. Intact Public Entities is offering this webinar on Ontario Regulation 239/02 Minimum Maintenance Standards for Municipal Highways (MMS) to remind staff of their obligations to road users. 

MMS – The Standard of Reasonableness

Snow covered and icy roads make winter driving difficult and the risk of collision increases. Municipalities must respond with winter control activities that are reasonable in the circumstance. The Supreme Court of Canada states that “A “reasonable” decision is based on a logical chain of reasoning. It has to make sense in light of the law and the facts”. The MMS sets out what is reasonable for many, not all, road maintenance activities. Compliance with the regulation and documenting your work assists in reducing risk exposure.

This webinar will: 1) provide a history of the MMS, why it was developed and by who, 2) review court decisions that have had an impact on municipal operations and the MMS, 3) discuss the sections of the regulation with a focus on winter operations, and 4) include a hands-on assignment to be completed during the webinar.

Target Audience:
This two-hour webinar will be of interest to front line supervisors, patrol persons, equipment operators and contractors hired to provide winter services.
